The presidential candidate of the Peoples Democratic Party (PDP) in the 2019 general elections, Atiku Abubakar, and his party, have formally filed their appeal against the judgement of the presidential election petitions tribunal at the Supreme Court.
The disclosure was made by Mike Ozekhome (SAN), a senior lawyer in the legal team of Atiku and PDP, This Day reports. According to Ozekhome, the appeal was predicated on 66 grounds.
We gathered that Ozekhome said the tribunal erred in its verdict on Atiku and PDP’s petition against the election of President Muhammadu Buhari.
Recall that on Wednesday, September 11, a five-man tribunal led by Justice Mohammed Garba dismissed the petition filed by Atiku and PDP for being incompetent and lacking in merit.
The PDP and Atiku want the Supreme Court to hold that the tribunal erred in its decision and consequently set the tribunal’s judgment aside and go ahead to declare them winner of the February 23 presidential election.
Atiku had put together 70 points as grounds for the appeal. According to a source, parts of the 70 grounds of appeal is that
“the judgement of the PEPT was based on the facts; the judgement was not on the issues presented to the Court of Appeal presidential tribunal by the petitioner, especially in relation to the respondent’s academic qualifications.”
“Secondly, Buhari said that he was recruited into the military in 1961 and Tarfa said in 1962, so what is the correct date of his recruitment into the army.”
